A Calling to Contribute
Despite ongoing challenges presented by the COVID-19 pandemic, King & Spalding personnel continued to connect with and give back to their communities in 2021.
Our lawyers and staff formed new, meaningful community partnerships and furthered many of our existing partnerships this past year. We partnered with legal services organizations to advocate for immigrants, the LGBTQ+ community, incarcerated persons, disabled veterans, survivors of domestic violence and other vulnerable members of society. We supported organizations that do critical work to combat food insecurity, advance educational efforts and bring our communities together.
As we come together in person more frequently in 2022, we remain proud of our efforts in 2021, in person and virtually, to support our communities through pro bono work, community service and philanthropy.

In 2021, King & Spalding formed a partnership with the Russell Innovation Center for Entrepreneurs (RICE), the nation’s largest nonprofit incubator for Black entrepreneurs. Through this partnership, our lawyers served as pro bono counsel for the Pacesetters program, a cohort of the most high-potential companies, providing individualized legal counsel on an as-needed basis. The team has also provided resources such as informational videos on legal topics, lectures and legal forms to support RICE’s entire entrepreneur population. More than 50 King & Spalding lawyers across eight offices worked with RICE entrepreneurs in 2021, and this exciting partnership remains active.
Hundreds of King & Spalding lawyers continued to assist Deferred Action for Childhood Arrivals (DACA) recipients with completing, reviewing and paying for their initial or renewal DACA applications through our UndocuNeighbor program. Having current DACA status allows these clients to remain in the U.S. legally, to go to school and to be employed. Since the inception of the UndocuNeighbor program, our lawyers have helped more than 500 DACA recipients.
Lawyers in King & Spalding’s California offices, working with the Disability Rights Education & Defense Fund as well as local education lawyers and advocates, successfully resolved a class action lawsuit over allegations that the Berkeley Unified School District failed to identify students with reading disorders and provide necessary accommodations. Under the terms of the settlement, Berkeley schools will offer universal screening for reading disorders and implement new reading programs that have been proven effective. These changes will be implemented over the next three years, and the King & Spalding team will be involved in monitoring their implementation.

King & Spalding lawyers from the Washington, D.C., office achieved a victory for a man on South Carolina’s death row in a habeas case challenging the effectiveness of trial counsel. Although the client’s childhood in South Carolina was marked by extreme poverty, abuse and neglect, his trial counsel withheld this critical mitigating evidence from the jury for reasons that did not stand up to scrutiny. The client’s counsel in the state court post-conviction proceedings, in turn, failed to pursue a mitigation-based ineffective assistance of counsel claim. On appeal, the King & Spalding team argued that trial counsel’s decision to withhold mitigation evidence constituted ineffective assistance of counsel. The Fourth Circuit agreed and took the extraordinary step of granting the client’s petition for habeas corpus, ensuring that the client will have a new sentencing proceeding.
Lawyers in King & Spalding’s London office represented a teacher at a top school in the UK who alleged he was fired for speaking out about the school’s policy of inflating predicted grades to make it easier for students from that school to apply to more competitive university programs. After a successful hearing in front of the Employment Tribunal, the King & Spalding team reached a favorable settlement on behalf of the client.

A cross-office team of King & Spalding litigators, working with the American Civil Liberties Union of Illinois, represented a certified class of transgender individuals incarcerated in the Illinois Department of Corrections (IDOC) in a lawsuit for denial of adequate treatment for gender dysphoria. IDOC had delayed or denied hormone therapy, evaluation for gender-affirming surgery, placement in gender-affirming facilities, provision of gender-affirming clothing and grooming items, and use of gender-affirming pronouns. Our team presented four days of evidence, including testimony by class members and expert witnesses, showing that IDOC was not compliant with the court’s preliminary injunction in favor of the class members and that IDOC’s revised policies and administrative directives were flawed. At the close of evidence, the court issued a rare ruling from the bench permanently enjoining IDOC from delaying or denying class members medically necessary care to treat gender dysphoria for any transgender inmate in an Illinois state prison. This case will likely become a playbook for similar litigation in other states.
Litigators across many King & Spalding offices, working with national and local advocates, represented a group of immigrants detained at three facilities in South Florida who were protesting the conditions of their confinement in light of the rapid spread of COVID-19 in prisons and jails. In 2020, our team won a preliminary injunction against Immigration and Customs Enforcement (ICE) that significantly improved confinement conditions, including multiple measures to lower the risk of COVID-19 transmission. In 2021, the firm negotiated a settlement agreement under which ICE is required to follow federal COVID-19 guidelines in its facilities, including maintaining a population density that allows for adequate social distancing, providing PPE at no cost, and providing unlimited soap and hand sanitizer.
A large team of King & Spalding lawyers, working with national and local advocates, has focused on improving mental health care in the Alabama Department of Corrections (ADOC) following a 2017 court declaration that mental health care in Alabama prisons was “horrendously inadequate” and an order that ADOC reform the system. During a seven-week trial in the summer of 2021, the team presented evidence of the continued horrific and inhumane conditions. In December 2021, the court issued a sweeping remedial order requiring ADOC to remedy and improve its mental health services.

Founders Day, celebrated every year by King & Spalding lawyers and staff, is a firmwide community service initiative commemorating the legacy of service and community engagement established by our founding partners 135 years ago. Pandemic-related educational disruptions have impacted families in many communities. In 2021, King & Spalding lawyers and staff found ways to safely support educators, students and caregivers as they navigated the pandemic.
Despite the challenges of the past two years, our communities feel stronger, more resilient and more connected than ever.

Administrative professionals and paralegals created 100 snack packs for the Atlanta Children’s Shelter and Prevent Child Abuse Rockdale as part of United Way’s “Unite for Service” week. Atlanta staff and associates provided 200 lunch bags for summer camp children at the Andrew P. Stewart Center.
Volunteers in Atlanta, Austin, Chicago, Los Angeles, New York, San Francisco, Silicon Valley, Singapore and Washington, D.C., participated in food drives and fundraising for local area food banks.
In February 2021, snow and ice storms in Texas created a need for water and nonperishable food items for our Austin office employees. As a result of great generosity, more items were donated than were needed. The extra items were donated to a University of Texas local food pantry to provide for snowbound students.
The Singapore office participated with Willing Hearts to raise money to provide meals to the underprivileged, needy and marginalized members of our society.
The Chicago office delivered gifts for more than 100 preschoolers and kindergartners at two schools: Nash Elementary and the Smyth School. A total of 316 gifts were distributed.
The Houston office participated in an Adopt-an-Angel program, providing gifts to 125 underprivileged children at 10 partner schools and organizations in the Houston area.
The Charlotte office provided 10 children with all the items on each child's Christmas wish list through the Alexander Youth Network. At Covenant Village Assisted Living, 60 residents received Christmas bags full of hygiene products, socks and candy. Fifty children and teens at Levine Children’s Hospital were given “Santa Bags” full of gifts along with candy treats. At The Relatives, teenage girls and boys were given stockings filled with age-appropriate gifts, and meals were provided on December 22, 2021.
